This happens more than people expect. A hiring manager gets a resume that looks perfect on paper, schedules the interview, and 15 minutes in realizes the candidate can’t hold a real-time technical conversation in English. Plenty of nearshore recruiters will find you a great candidate and hand you a 1099 arrangement to sort out yourself. That’s where most of the risk actually sits, not in the search.

The U.S. Department of Labor’s Wage and Hour Division recovered more than $1 billion in back wages between January 2021 and September 2024, much of it tied to worker misclassification. A full-time nearshore hire on a recurring monthly 1099 contract, working set hours for one company, looks a lot like an employee to a regulator. Not a great place to find out you were wrong.
